Is A Fire Risk Assessment A Legal Requirement?

The definition of house in multiple occupation (HMO)

The definition of house in multiple occupation (HMO) is contained in section 254 of the Housing Act 2004. The definition is complex and for detailed understanding then the Act itself should be studied. For general purposes the definition can be summarised as follows.

A building is an HMO if it:

  • Is occupied by more than one household and where more than one household shares (or lacks) an amenity such as a bathroom, toilet or cooking facilities.

  • Is occupied by more than one household and is a converted building, but not entirely self-contained flats (whether or not some amenities are shared or lacking).

  • Is converted self-contained flats but does not meet as a minimum standard the requirements of the 1991 Building Regulations, and more than one third of the flats are privately rented; or

  • An HMO declaration has been made by the Local Housing Authority (LHA) under section 255 of the Housing Act 2004.

Do I need to review my current risk assessment?

As the responsible person you must carry out and regularly review a fire risk assessment of the premises.

If you are responsible for a building, for example a employer, owner or occupier of premises that aren't a 'single private dwelling' (a private home), you need to make sure a suitably competent person completes a Fire Risk Assessment.

The Regulatory Reform (Fire Safety) Order 2005 - ARTICLE 9 PART 3 - 'Any such assessment must be reviewed by the responsible person regularly so as to keep it up to date'.

 

We recommend you should review your fire safety risk assessment annually (12months) to ensure your compliance with the regulatory reform (fire safety) order 2005 or sooner if:

  • Alterations are made to the structure of the building.

  • Personnel numbers increase significantly.

  • There has been a change in the use of premises.

  • Anything else that could impact the fire safety within the building.
